Terms of Service

1. Acceptance of Terms

By accessing or using SunSt AI ("Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Account & Eligibility

You must be at least 18 and licensed (or working under a licensed broker) to use real estate features. You are responsible for safeguarding your credentials.

3. Acceptable Use

You agree not to: (a) violate laws including TCPA, CAN-SPAM, state Do-Not-Call rules, RESPA and fair-housing laws; (b) upload content you don't have rights to or that infringes intellectual property; (c) reverse engineer, resell, sublicense, or scrape the Service; (d) misrepresent your identity, license status, or your clients'; (e) use the Service to send unsolicited bulk SMS, spam, or harassing communications; (f) attempt to access another user's account, team data, or our infrastructure. You — not SunSt AI — are responsible for obtaining all required consents (including prior express written consent for marketing calls/texts under the TCPA) before using outreach features.

4. Your Content

You retain ownership of leads, documents, and data you upload. You grant us a limited license to host, process, and display that data solely to operate the Service for you. We may use de-identified aggregate data to improve features.

5. AI Features

AI-generated content (scripts, summaries, contract field extraction, recommendations) is provided as suggestions only, may be inaccurate or out-of-date, and does not constitute legal, financial, tax, or real estate advice. You are solely responsible for reviewing, validating, and acting on AI output, and for compliance with all applicable broker / MLS rules. We make no warranty as to accuracy or fitness for any transaction.

6. Subscription & Billing

Plans, prices, and limits are shown at sign-up. Subscriptions auto-renew until cancelled. Fees are non-refundable except as required by law.

7. Termination

You may close your account at any time from Settings → Account. We may suspend or terminate for breach of these Terms, fraud, or abuse. On termination you may export your data for 30 days, after which it may be permanently deleted.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OF AI OUTPUT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL SUNST AI, SUNST REAL ESTATE LLC, OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOST BUSINESS, ARISING FROM OR RELATED TO THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

10. Indemnification

You agree to defend, indemnify, and hold harmless SunSt Real Estate LLC and its officers, employees and agents from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) your violation of these Terms or any applicable law (including TCPA, fair-housing, and MLS rules), or (c) content you upload or transmit through the Service.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles. Any dispute will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to personal jurisdiction there. YOU AND SUNST AI WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.

12. DMCA / Copyright

If you believe content on the Service infringes your copyright, send a notice under 17 U.S.C. § 512(c) to info@sunst.co with: (i) your physical or electronic signature; (ii) identification of the copyrighted work; (iii) the URL or location of the allegedly infringing material; (iv) your contact information; (v) a statement of good-faith belief; and (vi) a statement under penalty of perjury that the information is accurate and you are authorized to act. We may remove material and terminate repeat infringers.

13. Changes

We may update these Terms. Material changes will be announced in-product. Continued use after the effective date constitutes acceptance.
